Frequently Asked Questions
Why have I been contacted?
On the basis of genealogical research we have identified you as a possible heir to an estate with a positive cash flow. Positive means that the estate is not insolvent.
Why was I not informed about the inheritance directly by the Probate Court?
The inheritance mass remains secured in a court deposit and an estate administrator will be appointed to find unknown heirs. If the research is very difficult (foreign, temporarily tedious and expensive), the estate administrator contacts professional companies that search for unknown heirs – in this case GEN sp. z o. o.
For this reason, we have the power of attorney of an estate administraion officer or of a person authorised by state institutions to manage the estate.
Are there any costs related to the cooperation with GEN sp. z o.o.?
All costs are borne by the company. Only if the inheritance is paid out to the heirs, GEN sp. z o.o. charges a percentage fee. The fee is determined in advance by signing a success-based agreement with us. The fee covers the costs of genealogical searches, court proceedings, lawyers and proving the right to your inheritance. However, if the inheritance case is not successfully completed, you do not bear any costs.
How do I know that I will not inherit debt?
The fee is taken from the inheritance that is paid to you. If the inheritance was in debt and the fee collected from you, also GEN sp. z o.o. would have incurred losses/had to pay off the debt. The company deals only with the search for heirs with the right to a positive inheritance. Moreover, we would like to inform you that it is clearly stated in the agreement that you are not exposed to a indebted inheritance.
Why is the fee rate so high?
The fee is approved by the court and usually amounts 33-35%. The fee can also be higher depending on the country. The high costs are caused by difficulties and the long time of genealogical research.
Will there be anything left of the inheritance after the fee has been deducted?
In the agreement it is ensured that you inherit a positive cash flow – even after deducting compensation, expanses and inheritance tax possibly due, you can still enjoy your inheritance. Thus, you take no risk whatsoever.
How do I know that your company is a serious enterprise?
The parent company has been operating since 1990 and is one of the largest companies in this sector in Germany, employing over 70 employees and with numerous branches in Germany, Poland, the Czech Republic and the United States. Our reliability is also proved by the fact that we are often asked for help by state institutions, estate administrators, state attorneys, municipalities and courts.
Close cooperation with these bodies enables our company to operate. From our experience we can also state that Polish state institutions protect Polish citizens and without demonstrating legal interest we do not receive access to data.
What if I do nothing?
The inheritance shall be paid lawfully to the State from which the inheritance originates.
Who has left me the inheritance?
In most cases, it is the succession of a person who has not left a will/testament and the succession therefore takes place in the manner laid down by the law of the State in which the succession originates. The succession thus inherits from a person related to you. Very often these are people unknown to the heirs who, among other things, emigrated during the war.
How much time does it cost me?
The time you have to spend on the solution is mainly: signing the agreement, sending it by post and possibly obtaining a few photocopies/withdrawals. All other formalities are handled by GEN sp. z o.o.
How long does the inheritance proceedings last?
This depends on many factors beyond the competence of GEN sp. z o.o., such as the statutes of individual countries where the inheritance is held. The duration of the case may be estimated from a few months to even a few years.
